Investment.

Upon arrival, there isn’t nearly enough air to fill my lungs, so in desperation, I scream. Pulling in all that I can because suddenly I feel empty. The comfortable heavy warmth in my chest has been displaced by vacuum. I have no control over where I am. My arms and legs, unbound, find freedom a challenge. And, although I feel hands pulling and fingers pressing, I have no idea why. It is cold. So, I reach for warmth and I find it in purity. I know where I came from; I did not want to leave and with grief comes depth and in the deep I find surrender. It was warm and I swam in it before I knew you. I would go back, but that was before I saw your eyes, before I was pulled into this world and onto your lap a sloppy mess. I need you and without you I am sure I would not thrive.

p.s. i can only imagine.

Now you guys know why I get so tired of everything.

I'm not gonna deal with Vultures anymore. They act like a dog with a dead rat--or a Vulture with a dead horse.

"Set of rat's testicles"? How can they give even THAT, since we don't know them?

I am so through with this.

Imagine if all you were trying to do was keep a journal though, and this started to happen. Wouldn't it start to look like more trouble than it was worth? It's just a blog. Mayo could shut it down anytime and write his thoughts elsewhere without all the drama, but he doesn't. I can only imagine that he keeps it open only for us now, because he knows we'd (most of us) be sad to see him leave. It really can't be his responsibility. Journals are supposed to offer you comfort and release and all of that junk. It's supposed to be an escape from drama.

Do I think that Mayo is a prickly cactus who blows hot and cold and who has gotten really distant lately? Well duh, yeah I do. I really do miss the early days of this blog when he hung around more and played games and chatted with us etc.

The anons like to blame this on me. But I wonder if they've ever looked to themselves and asked if maybe they are part of the reason that Mayo doesn't talk to us much anymore.

Hello everyone. Sorry my post is so long but I think the anons going after Kapu should read this.

If this doesn't stop you think about it this way every time you do shit like this you get the government more involved in what is going on, on the Internet. You are making a place that was free for you to do almost anything not like that anymore. So just stop it.

In the United States

The current US Federal Anti-Cyber-Stalking law is found at 47 USC sec. 223.

The first U.S. cyberstalking law went into effect in 1999 in California. Other states include prohibition against cyberstalking in their harassment or stalking legislation. In Florida, HB 479 was introduced in 2003 to ban cyberstalking. This was signed into law on October 2003. [13]

Some states in the U.S. have begun to address the issue of cyberstalking:

* Alabama, Arizona, Connecticut, Hawaii, Illinois, New Hampshire, and New York have included prohibitions against harassing electronic, computer or e-mail communications in their harassment legislation.
* Alaska, Florida, Oklahoma, Wyoming, and California, have incorporated electronically communicated statements as conduct constituting stalking in their anti-stalking laws.
* Texas enacted the Stalking by Electronic Communications Act, 2001.
* A few states have both stalking and harassment statutes that criminalize threatening and unwanted electronic communications.
* Other states have laws other than harassment or anti-stalking statutes that prohibit misuse of computer communications and e-mail, while others have passed laws containing broad language that can be interpreted to include cyberstalking behaviors

Cyberstalking has also been addressed in recent U.S. federal law. For example, the Violence Against Women Act, passed in 2000, made cyberstalking a part of the federal interstate stalking statute. Still, there remains a lack of legislation at the federal level to specifically address cyberstalking, leaving the majority of legislative prohibitions against cyberstalking at the state level.[7]

Most stalking laws require that the perpetrator make a credible threat of violence against the victim; others include threats against the victim's immediate family; and still others require the alleged stalker's course of conduct constitute an implied threat. While some conduct involving annoying or menacing behavior might fall short of illegal stalking, such behavior may be a prelude to stalking and violence and should be treated seriously.[14]

Online identity stealth blurs the line on infringement of the rights of would-be victims to identify their perpetrators. There is a debate on how Internet use can be traced without infringing on protected civil liberties.
Stalking is a legal term for a pattern of offensive behavior involving repeated harassment or other forms of invasion of a person’s privacy in a manner that causes fear to its target.

Statutes vary between jurisdiction but may include such acts as:

repeated physical following
unwanted contact (by letter or other means of communication)
observing a person’s actions closely for an extended period of time
contacting family members, friends, or associates inappropriately

Stalking can also include seeking and obtaining the person’s personal information in order to contact them; e.g. looking for their details on computers, electoral rolls, personal files and other material with the person’s personal details without their consent. Personal details include their date of birth, marital status, home address, email address, telephone number (landline and mobile), where they work, or which school, college or university they go to; and personal information on their family and friends and any other sensitive and confidential information (e.g. medical conditions and disabilities etc.)

Harassment
From Wikipedia, the free encyclopedia

Harassment refers to a wide spectrum of offensive behavior. When the term is used in a legal sense it refers to behaviors that are found threatening or disturbing, and beyond those that are sanctioned by society.

Cyberstalking
From Wikipedia, the free encyclopedia

Cyberstalking is the use of the Internet or other electronic means to stalk someone.

It has been defined as the use of information and communications technology, particularly the Internet, by an individual or group of individuals, to harass another individual, group of individuals, or organization. The behavior includes false accusations, monitoring, the transmission of threats, identity theft, damage to data or equipment, the solicitation of minors for sexual purposes, and any form of aggression. The harassment must be such that a reasonable person, in possession of the same information, would regard it as sufficient to cause another reasonable person distress.

Definitions
Stalking is a continuous process, consisting of a series of actions, each of which may be entirely legal in itself. Lambèr Rooyackers writes that:

“Stalking is a form of mental assault, in which the perpetrator repeatedly, unwantedly, and disruptively breaks into the life-world of the victim, with whom he has no relationship (or no longer has), with motives that are directly or indirectly traceable to the affective sphere. Moreover, the separated acts that make up the intrusion cannot by themselves cause the mental abuse, but do taken together (cumulative effect).”

CyberAngels has written about how to identify cyberstalking:

When identifying cyberstalking “in the field,” and particularly when considering whether to report it to any kind of legal authority, the following features or combination of features can be considered to characterize a true stalking situation: malice, premeditation, repetition, distress, obsession, vendetta, no legitimate purpose, personally directed, disregarded warnings to stop, harassment, and threats.

Paul Bocij identifies a number of key factors:

False accusations. Many cyberstalkers try to damage the reputation of their victim and turn other people against them. They post false information about them on websites. They may set up their own websites for this purpose. They post allegations about the victim to newsgroups and chat rooms.

Attempts to gather information about the victim. Cyberstalkers may approach their victim’s friends, family and work colleagues to obtain personal information. They may advertise for information on the Internet, or hire a private detective.

Encouraging others to harass the victim. Many cyberstalkers try to involve third parties in the harassment. They may claim the victim has harmed the stalker or his family in some way, or may post the victim’s name and telephone number in order to encourage others to join the pursuit.

False victimization. The cyberstalker will claim that the victim is harassing him. Bocij writes that this phenomenon has been noted in a number of well-known cases.

Attacks on data and equipment. They may try to damage the victim’s computer by sending viruses

What Is Cyberstalking?
From the U.S. Department of Justice

Although there is no universally accepted definition of cyberstalking, the term is used in this report to refer to the use of the Internet, e-mail, or other electronic communications devices to stalk another person. Stalking generally involves harassing or threatening behavior that an individual engages in repeatedly, such as following a person, appearing at a person’s home or place of business, making harassing phone calls, leaving written messages or objects, or vandalizing a person’s property. Most stalking laws require that the perpetrator make a credible threat of violence against the victim; others include threats against the victim’s immediate family; and still others require only that the alleged stalker’s course of conduct constitute an implied threat. While some conduct involving annoying or menacing behavior might fall short of illegal stalking, such behavior may be a prelude to stalking and violence and should be treated seriously.

Nature and Extent of Cyberstalking

Although online harassment and threats can take many forms, cyberstalking shares important characteristics with offline stalking. Many stalkers - online or off - are motivated by a desire to exert control over their victims and engage in similar types of behavior to accomplish this end. As with offline stalking, the available evidence (which is largely anecdotal) suggests that the majority of cyberstalkers are men and the majority of their victims are women, although there have been reported cases of women cyberstalking men and of same-sex cyberstalking. In many cases, the cyberstalker and the victim had a prior relationship, and the cyberstalking begins when the victim attempts to break off the relationship. However, there also have been many instances of cyberstalking by strangers. Given the enormous amount of personal information available through the Internet, a cyberstalker can easily locate private information about a potential victim with a few mouse clicks or key strokes.

The fact that cyberstalking does not involve physical contact may create the misperception that it is more benign than physical stalking. This is not necessarily true. As the Internet becomes an ever more integral part of our personal and professional lives, stalkers can take advantage of the ease of communications as well as increased access to personal information. In addition, the ease of use and non-confrontational, impersonal, and sometimes anonymous nature of Internet communications may remove disincentives to cyberstalking. Put another way, whereas a potential stalker may be unwilling or unable to confront a victim in person or on the telephone, he or she may have little hesitation sending harassing or threatening electronic communications to a victim. Finally, as with physical stalking, online harassment and threats may be a prelude to more serious behavior, including physical violence.

While there are many similarities between offline and online stalking, the Internet and other communications technologies provide new avenues for stalkers to pursue their victims.

A cyberstalker may send repeated, threatening, or harassing messages by the simple push of a button; more sophisticated cyberstalkers use programs to send messages at regular or random intervals without being physically present at the computer terminal. California law enforcement authorities say they have encountered situations where a victim repeatedly receives the message “187″ on their pagers - the section of the California Penal Code for murder. In addition, a cyberstalker can dupe other Internet users into harassing or threatening a victim by utilizing Internet bulletin boards or chat rooms. For example, a stalker may post a controversial or enticing message on the board under the name, phone number, or e-mail address of the victim, resulting in subsequent responses being sent to the victim. Each message — whether from the actual cyberstalker or others — will have the intended effect on the victim, but the cyberstalkers effort is minimal and the lack of direct contact between the cyberstalker and the victim can make it difficult for law enforcement to identify, locate, and arrest the offender.

First, Mayo owns this blog. If he were so inclined or disgruntled over the drama, he would delete the comments or make it to where he must approve comments.

He obviously realizes that the more drama, the more traffic, the more attention he receives.

Second, I think you all have this idealized image of Mayo in your minds (mostly because at the beginning -or still- you think/thought he was Gerard Way). You don't see his signs of desperation. His tantrums for attention. He needs this, to fuel his ego. And you all definitely fuel his ego.

I never post as anon, but I am responding to 'information' and don't have time to 'talk' - Sexual harassment is a lot more varied in situation than just the workplace or learning environments, which is what I thought.

From 'wiki':

Varied circumstances

Sexual harassment can occur in a variety of circumstances:

* The harasser can be anyone, such as a supervisor, a client, a co-worker, a teacher or professor, a student, a friend, or a stranger.

* The victim does not have to be the person directly harassed but can be anyone who finds the behavior offensive and is affected by it.

* While adverse effects on the victim are common, this does not have to be the case for the behavior to be unlawful.

* The victim can be male or female. The harasser can be male or female.

* The harasser does not have to be of the opposite sex.

* The harasser may be completely unaware that his or her behavior is offensive or constitutes sexual harassment or may be completely unaware that his or her actions could be unlawful.

(Adapted from the U.S. Equal Employment Opportunity Commission)[3]

Varied behaviors

One of the difficulties in understanding sexual harassment is that it involves a range of behavior, and is often difficult for the recipient to describe to themselves, and to others, exactly what they are experiencing. Moreover, behavior and motives vary between individual harassers.

New York City
Sexual Harassment

As women have continued to enter and advance in the workplace, they have too often been subjected to sexual harassment in the workplace. This may include vulgar and profane remarks directed towards the employee, inappropriate and unwanted touching or other lewd conduct, or demands from a boss for sexual favors as a condition for continued employment, raises, or bonuses. All of this conduct constitutes sexual harassment, and is unlawful under Federal, state, and local law. As an employee, you are entitled to a workplace free of sexual harassment.

Governing Laws

Title VII of the Civil Rights Act of 1964 prohibits discrimination "based on sex." Courts have held that Title VII prohibits subjecting an employee to sexual harassment in the workplace. The New York State Human Rights Law and the New York City Human Rights Law also contain similar provisions concerning sexual harassment. There are two basic forms of sexual harassment. The first is "quid pro quo" sexual harassment, i.e., someone in a position of authority either offers advancement for sexual favors or threatens the loss of employment for failure to provide sexual favors or both.

The second type of sexual harassment is "hostile work environment." This occurs when employees are subjected to unwanted conduct, innuendos or advances by either supervisors or coworkers. An employer is required to take appropriate action to prevent and correct such behavior.
Who Can Harass and be Harassed

Although sexual harassment is most commonly directed toward women, in some cases it is directed towards men. So long as the harassment in question is "based on sex," it is unlawful. In addition, some employees may experience discrimination based on their sexual orientation. Laws covering employers in New York State and New York City prohibit discrimination based on sexual orientation, and therefore prohibit sexual harassment based on sexual orientation.

Sexual harassment is a problem that needs to be dealt with aggressively. If you are a victim of this type of abuse, contact a New York City sexual harassment lawyer

HEY!

I only tackle you because I less than three you. ;)

sdock10 said...

Hi Elena,

How goes it?

Mayo, so um, can I have a praline or not? My mama makes really good homemade pralines. We pecans that I picked up with my very own little bitty hands.

Just saying..

Anonymous said...

Look, I'm not trying to start trouble, really, I'm not. I'm only trying to make you all understand that when it comes to the law, what the anons did to Kapunua does not appear to have involved any lawbreaking or cyber-stalking. She was the one who made all of her info readily available in a public forum.

Also, she was the one who posted unproven accusations about clients who frequented her workplace. She even posted a link to their website, revealing their identity in a public forum. If anyone here has come close to breaking any laws regarding internet privacy, defamation of character, etc., it was Kapunua, and I firmly believe that her employer had no alternative but to let her go, lest he risk legal action against himself and possibly Kapunua.

I am not condoning the actions of the vindictive anons who got her into trouble. I think they are jerks who'll get what's coming to them - Karma and all that. But what they did wasn't illegal. Creepy, mean, indefensible, yes. Illegal, no.

I would just like to suggest that the rest of you keep your personal information private unless it's on a friends-locked blog or journal. Only let the people you know and trust have access to it.

Once again, I am only saying this to be helpful and I don't have a blogger account. So don't jump all over me for being anon.

sdock10 said...

Mustard,

What you doing?

Owwch! My knees and elbows! You'd think they'd be used to this kind of punishment by now.

sdock10 said...

*waves to Anons and lurkers*

Martha Smith-Jones said...

Anon you should read this

When the term is used in a legal sense it refers to behaviors that are found threatening or disturbing, and beyond those that are sanctioned by society.

elena said...

Hello Mustard and Ergo

Ergo, I made you a Ray Toro all by mahself.

Ergo,

What is it that you titor again? Organic chemistry?

Martha Smith-Jones said...

hello ep

Martha Smith-Jones said...

Hello elena

sdock10 said...

Wow, I come home from work. Blow through Mayo's door expecting to find all kinds of action, maybe some shit being stirred, and some pralines, but it's turned out to be eerily quiet in here all of a sudden.

Awwh, and I was so prepared to make everyone feel better about themselves by being less pathetic than me.

Smoke said...

I want a praline. :(

Just fantastic, Mayo? Not fantabulous? ^_~

Hi everyone!

I'm tired.

sdock10 said...

I wanted him to be fantabuliriffic, Smoke, but I guess that's pushing things to extremes.

I'm tired too.

Mayo's hording (is that the way it's spelled) his pralines.

Anonymous said...

Yes, Martha, but she put her info out there, hence implicitly giving her consent. It's not like they went searching through voter's registrations or legal documents or anything.

Like I said, I'm just trying to be helpful. What the anons did was wrong and it wasn't fair. But life isn't fair and right/wrong often have very little to do with the law.

Anonymous said...

All we need is some ice cream and a hug

ergoproxy said...

HOLY COW HIS HAIR!!
he really just has that guitar hero stance down pat doesn't her! Wonder if he ever practised in font of the mirror?

thanks mustard

sdock this morning it's usually chemistry or maths, yr 12. But I had to help with Biol for her on sunday. This afternoon it's yr 10 maths, yr 11 maths and biol plus english or anything else, once you teach you can help with almost anything that is a straight learning subject (ie not with particular skills like accounting )

Anonymous said...

Hey, SMOOOOKE!

It's good Mayo's fantastic. Better than not being fantastic. He's probably fantastic because of all the pralines he's chowing on.

Martha Smith-Jones said...

hello S&V

sdock10 said...

Awwh, what's the youtube video? I can't watch it on my slow ass dial up!

*nom, nom, nom*

Well, so, I got marshmallows rolled in chocolate and pecans! Homemade too. They are scrumtious!

Smoke said...

Hey!

MUUUUUSSSSSSTTTTAAAAARRDDDDDDD!!!

You're right. I'm glad he's fantastic. ^_^

Martha Smith-Jones said...

Anon putting her info out there doesn't mean that she wanted people to use it to harass her. Going by what you are saying everyone who has their name in the phone book wants to be harassed.

ergoproxy said...

I'd be fantastic if I had pralines.......oh hang on I do!

I had some given me an I hid them from the chocolate thieves that frequent my home
woo hoo!

are they counted as a breakfast food?

Anonymous said...

i'm hungry, i might go to Taco Hell for a Crapito or a Fashita

Martha Smith-Jones said...

Well it is the food anon. I think i want round table pizza

Smoke said...

Taco Hell would be good. ^_^

Ergo! Of course they are breakfast food! Yum!

Mayo,

You should try my mama's homemade pralines. Solly may have already told you that. I don't know. But they are delish!

Anonymous said...

Okay, Martha. I'm not trying to argue with you. I admit that I only watch this blog sporadically and maybe I missed something. I was under the impression that the anons sent emails to the clients that Kapunua accused on this blog of sexually harassing one of her co-workers. Did they do something else? I mean, have they been harassing her at home, following her or sending her threats of some kind?

Anonymous said...

you can go to Pizza Slut for a Shit Lovers pizza

sdock10 said...

Taco Hell sounds hella nasty to me, why not some Boobie Scewsday's?

Martha Smith-Jones said...

The anon sent emails to her work and have been talking about sending emails to the people that she dances with and to people in her kung-fu class.

She even lost her job over this.
